A liberdade criativa e de expressão é mais do que um direito; é um pilar fundamental de uma sociedade saudável, e uma medida precisa do seu desenvolvimento. A escrita de humor coloca-se por opção nas fronteiras dessa liberdade, precisamente onde é mais difícil e necessário defendê-la. Confiamos na capacidade do nosso sistema judicial para saber proteger este bem simultaneamente tão frágil e precioso.

A lei que está ser discutida no parlamento espanhol não pretende punir os utilizadores que descarregam músicas, filmes ou séries de televisão, mas sim os sites que, ilegalmente, disponibilizam esses conteúdos para descarga. Como é referido no comunicado que a seguir transcrevemos, os donos desses sites de partilha de ficheiros ilegais não podem agir "debaixo da ideia errada de que liberdade significa o direito a partilhar o que querem, quando querem, e de graça".

A pirataria de conteúdos na internet afeta diretamente os direitos dos autores, incluindo os guionistas, e em muitos casos prejudica gravemente a sua capacidade de obter rendimentos através das suas criações. Como tal, em última instância, é uma ameaça a médio prazo para a evolução e sobrevivência das indústrias criativas.

A message from your colleagues at ALMA, the Spanish Scriptwriters Union.
For the first time in Spain a member of parliament has bravely proposed an anti-piracy law.
A softline proposal, it did not suppose prosecuting the downloader, as in the USA, rather attempting only to close the offending web sites.
The political reaction has been to reject this law, thereby legalizing indiscriminate piracy by default. Many of these web site owners, downloaders themselves, have reacted by launching a campaign under the apparent guise of freedom and in defence of “ the right to share”, ignoring the fact that what they are sharing is not theirs to share, and under the mistaken idea that freedom means the right to share what they want, when they want and for free.
US TV series are the most popular illegal downloads in Spain; you are therefore the greatest victims of this free for all.
Various Spanish writers have signed a manifesto demanding political resolve and above all justice in this matter.
As this issue affects not only ourselves, we ask you to please add your name to the petition in the hope that illegal downloaders see that we, the affected, are aware of what is happening and that every time they see your name in the credits of an illegally downloaded series they think: “I am stealing from those that give me enjoyment”.

1. Estabelecer um sistema de informação nos sites da FSE e IAWG para manter informados os membros de cada organização acerca das actividades da outra.
2. Implementar um sistema de troca de informação entre as associações sobre assuntos de interesse colectivo, estabelecendo e fazendo circular uma lista de contactos de todas as associações de argumentistas, e publicando e distribuindo ocasionalmente um boletim electrónico global.
3. Destacar observadores para as reuniões de cada organização.
4. Organizar um grupo de trabalho virtual para criar um glossário básico de termos relacionados com os argumentistas, a escrita e as remunerações, que possa ser aceite globalmente.
5. Organizar um grupo de trabalho virtual para definir termos básicos sobre a definição de créditos de autoria, que possam ser aceites globalmente.
6. Estabelecer uma campanha comum sobre o direito à negociação colectiva, começando pela análise dos problemas comuns.
7. Estabelecer uma campanha conjunta sobre o futuro das sociedades colectoras de direitos no mundo digital, começando pela análise das relações das associações de argumentistas com as sociedades colectoras de direitos em todo o mundo.
8. Estar prontos a dar apoio mútuo na eventualidade de qualquer crise que possa surgir, através de actividades de solidariedade apropriadas.
9. Tomar nota dos debates e conclusões da primeira Conferência Mundial de Argumentistas.
10. Iniciar uma discussão acerca da conveniência e possibilidade prática de criação de uma organização global de argumentistas.

Joint Activity Programme – IAWG/FSE

The Board of the FSE and the PRG of the IAWG have discussed the strengthening working relationships between the two organizations, which have grown quickly following the solidarity campaigns of guilds around the world with their colleagues in the writers’ strike in the United States which ended in February 2008, and which will be further cemented during the first World Conference of Screenwriters in Athens in November 2009.

Recognizing the limited resources of both organizations and the press of many priorities but nonetheless determined to strengthen and deepen working relationships between our organizations in the interest of writers everywhere we have agreed that we will:

1. Establish an information system on the FSE and IAWG websites to keep member guilds of each organization informed of the activities of the other.
   
2. Agree a system of exchange of information between guilds about topics of collective interest, by establishing and circulating a contact list of all the world’s writers’ guilds and by publishing and distributing an occasional global e-newsletter.
   
3. Arrange to have observers at one another’s meetings.
   
4. Set up a group to work together virtually to agree a glossary of basic terms related to writers, writing and their remuneration that could be agreed globally.

6. Establish a joint campaign on the right to collective bargaining, beginning with an analysis of common problems.

8. Stand ready to support one another in the event of any crisis situation by appropriate solidarity activities.
   
9. Take note of the debates and conclusions of the first World Conference of Screenwriters.
   
10. Initiate a discussion about the desirability and practicality of establishing a global organization for screenwriters.
     

As histórias influenciam os nossos comportamentos e dão forma à nossa cultura. Ajudam-nos a compreender. As histórias conquistam o medo. As histórias têm poder. Enquanto argumentistas, contadores de histórias do nosso tempo, temos consciência do nosso papel e responsabilidade, e unimo-nos para garantir que poderemos continuar o nosso trabalho neste novo ambiente.

Os desafios criativos e financeiros que encaramos só podem ser ultrapassados se juntarmos forças e trabalharmos em conjunto. Insistimos na capacidade individual de cada um dos vinte e cinco mil argumentistas cujos representantes estão aqui reunidos para ver e entender o mundo da sua própria maneira, e reflectir essa perspectiva única nas suas histórias. Exultamo-nos por saber que a criatividade individual é o que nos aproxima na defesa e promoção dos nossos direitos e objectivos comuns.

Subscrevemos as ambições e intenções da Carta da FSE, da Carta da IAWG, e do Manifesto dos Argumentistas Europeus.

Exigimos o direito de todos os argumentistas serem reconhecidos como autores das obras audiovisuais que escreveram, e justamente recompensados por todo e qualquer uso dado ao seu trabalho.

Iremos pois envolver-nos numa colaboração activa em campanhas que procurem concretizar os nossos objectivos comuns.

Comprometemo-nos a trabalhar em conjunto para defender e ampliar os direitos dos escritores audiovisuais.

World Screenwriters Declaration

In the new digitised and globalised world, we screenwriters have today come together, in Athens Greece, to discuss our central role in the creation of the stories that are carried with such impact to the world’s myriad screens and to people’s minds and hearts.

Stories influence our behaviour and shape our culture. They help us understand. Stories can conquer fear. Stories have power. As screenwriters, the storytellers of our time, we are conscious of our role and our responsibility and we have met to make sure that we can continue our work in the new environment.

The creative and financial challenges which we face, can only be met if we join forces and work together. We insist on the individual capacity of every one of the twenty five thousand screenwriters, whose representatives are gathered here, to see and understand the world in their own way and to reflect that unique perspective in their stories. We exult in the knowledge that individual creativity is what brings us together to defend and assert our common rights and goals.

We endorse the ambitions and intentions of the Charter of the FSE, the Charter of the IAWG and the Manifesto of the European Screenwriters.

We demand the right of screenwriters everywhere to be acknowledged as an author of the audiovisual work which they have written and to be fairly compensated for each and every use made of their work.

In pursuit of these objectives we will engage in active collaboration on campaigns that seek to achieve our common goals.

We pledge to work together to defend and extend the rights of writers for the screen.
